Can I use my American History X profile picture?

My profile picture suddenly disappeared and I was wondering if that wasn't allowed. I thought it was okay for me to do it because another mod had the same picture on their profile.

It wasn't racist either. If you watch the movie and see the context, it was about overcoming hate and bigotry. I guess I'm just a bit confused.
